Personal data is information relating to an identified or identifiable natural person (the “Data Subject”), such as name, identification number, location data, an online identifier, or one or more elements of the physical, physiological, genetic, psychological, economic, cultural or social identity of such person (“Personal Data”).

The purpose of this Notice is to inform you of any operation or set of operations, whether automated or not, such as the collection, recording, organization, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of access enabling, comparison or interconnection, limitation, deletion or destruction (“Processing”) of your Personal Data.
At all times, you are the sole owner of the Personal Data you provide to us. By accepting this Notice, we act as the “Data Controller” of the Processing of your Personal Data and undertake to collect and use them only in accordance with this Notice and exclusively for the purposes you have authorized herein.
This Notice applies to any website owned by COBI, as well as related sites, mobile applications and digital tools, regardless of the form and place of access.

At COBI we collect your Personal Data only to the extent that you provide them to us. By accepting this Notice and providing your Personal Data, you consent to the Processing of your Personal Data as set forth herein.
To use our platform you must have accepted our Terms and Conditions and created a user account with COBI.

At COBI we implement appropriate technical, administrative and organizational security measures to ensure a level of security that protects your Personal Data against destruction, loss, alteration, unauthorized disclosure or access, such as: (i) pseudonymization and encryption of personal data, (ii) the ability to ensure ongoing confidentiality, integrity, availability and resilience of processing systems and services, (iii) the ability to restore availability and access to Personal Data quickly in the event of a physical or technical incident, and (iv) a process for regular testing, assessment and evaluation of the effectiveness of technical and organizational measures. Notwithstanding the foregoing, if any security breach occurs that significantly affects your patrimonial or moral rights, we will notify you immediately once we become aware of such breach so you may take the appropriate actions.
SENSITIVE PERSONAL DATA
Sensitive Personal Data are those affecting the most intimate sphere of the Data Subject, or whose misuse may give rise to discrimination or serious risk, such as racial or ethnic origin, health status, genetic information, religious, philosophical or moral beliefs, union membership, political opinions or sexual preference.
At COBI, we do not process Sensitive Personal Data. Should you provide any, they will be used exclusively to the extent authorized and for the minimum time necessary.
PURPOSES OF PROCESSING
a. Primary purposes
At COBI we collect your Personal Data for the following purposes: (i) to identify and manage your account registration, (ii) to respond to user inquiries, (iii) to carry out procedures necessary to formalize agreements, (iv) processing, updating, modifying, canceling and/or confirming services, products and information sent by COBI through the Website, mobile applications, phone calls and/or email, (v) to comply with obligations contracted with the Data Subject, (vi) to respond to requests to exercise cancellation of consent or ARCO Rights.
b. Secondary purposes
Personal Data may also be used for additional purposes not directly related to services or products but which help us provide better service: (i) service quality evaluation, (ii) sending news, offers and promotions, (iii) newsletters, (iv) marketing, advertising and commercial prospecting, and (v) design and development of technological tools.
As Data Controllers, we ensure your data are relevant, correct and updated. When no longer necessary, they will be canceled in accordance with applicable law.
PERSONAL DATA TRANSFERS
We undertake not to transfer your Personal Data to Third Parties without your prior consent, except for the exceptions provided in Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties: (i) when the transfer is provided for in a Law or Treaty to which Mexico is a party; (ii) when the transfer is necessary for medical prevention or diagnosis, the provision of healthcare assistance, medical treatment or the management of healthcare services; (iii) when the transfer is made to controlling companies, subsidiaries or affiliates under the common control of the Data Controller, or to a parent company or any company within the same corporate group of the Data Controller that operates under the same internal processes and policies; (iv) when the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the Data Subject, by the Data Controller and a Third Party; (v) when the transfer is necessary or legally required for the safeguarding of a public interest, or for the procurement or administration of justice; (vi) when the transfer is necessary for the recognition, exercise or defense of a right in a judicial proceeding; and (vii) when the transfer is necessary for the maintenance or fulfillment of a legal relationship between the Data Controller and the Data Subject.
OPTIONS TO LIMIT USE OR DISCLOSURE
To limit use or disclosure, or to stop receiving promotions, you may register in our internal exclusion lists following the procedure in the ARCO Rights section.
ARCO RIGHTS (Access, Rectification, Cancellation, Opposition)
You may exercise your rights by emailing comunicacion@cobi.org.mx
including: name, address or response method, proof of identity, description of data, supporting documents, and rectification evidence if applicable. We will respond within 20 business days and execute within 15 if applicable.
LIMITATION AND PORTABILITY
You may limit Processing or request transmission of your data following the same ARCO procedure.
REVOCATION OF CONSENT
You may revoke consent at any time following the same ARCO procedure.
USE OF COOKIES, WEB BEACONS AND OTHER TRACKING TECHNOLOGIES
In addition to the Personal Data mentioned in this Notice, cookies are stored on your computer when you visit and use our website.

At COBI we do not collect Personal Data from individuals under 18 years of age. If you are a minor and for any reason provide us with such information, once we become aware through our verification process we will proceed with the immediate deletion of your Personal Data.
